Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Starverb ("Starverb", "we", "us"), governing your use of the Starverb website, apps and services at starverb.com (the "Service"). Please read them carefully. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
§1Eligibility
You must be 18 years or older to use Starverb. By using the Service you confirm that you are 18 or over and that you can form a binding contract with us.
§2The Service
Starverb is a music-discovery tool that maps the influences between artists, bands and genres, and lets you explore, save and organise what you find into personal collections ("Moods").
We may add, change or remove features at any time.
The Service is provided free of charge and is offered on an "as is" and "as available" basis (see Sections 9 and 10).
§3Your account
- You sign in with a one-time code sent to your email (or, optionally, via Apple, Google or Spotify). Keep your email account secure — anyone with access to it may be able to access your Starverb account.
- You are responsible for activity that happens under your account.
- You must give accurate information and keep it up to date.
- You can delete your account at any time in the app.
§4Acceptable use
You agree not to:
- use the Service for any unlawful purpose or in breach of these Terms;
- copy, scrape, harvest or bulk-download the Service's data or content except as expressly permitted;
- attempt to disrupt, overload, reverse-engineer, or gain unauthorised access to the Service or its systems;
- upload or submit content that is unlawful, infringing, misleading, abusive, or that you don't have the right to submit;
- misrepresent your identity or impersonate others; or
- use the Service to build or train a competing dataset or product without our written permission.
We may suspend or terminate access if you breach these Terms.
§5Your submissions and content
Starverb lets you submit information (such as suggested artists or genres) and create content (such as Mood names and notes) ("User Content").
- You keep ownership of your User Content.
- You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, adapt and use your User Content for the purpose of operating, improving and promoting the Service.
- You confirm you have the rights to submit your User Content and that it doesn't infringe anyone else's rights or break the law.
- We may review, moderate, edit or remove submissions, and we are not obliged to publish or keep any submission.
§6Intellectual property
- The Service, including its design, software, branding and original content, is owned by us or our licensors and is protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the Service for your own non-commercial use.
- Artist names, band names, genre information and related images are the property of their respective owners. Images may be displayed from third-party sources (such as Wikipedia/Wikimedia) under their own licences, and music playback and links are provided through third parties such as Spotify under their terms.
- "Starverb" and our logos are our marks and may not be used without permission.
§7Third-party services and links
The Service integrates with and links to third-party services (for example Spotify's embedded player and streaming links, and sign-in providers).
We don't control those services, we're not responsible for them, and your use of them is governed by their own terms and privacy policies.
§8Accuracy of music data
The influence, "roots", "legacy" and "kindred" relationships in Starverb are drawn from public data sources (such as Wikidata and similar) and automated processing, and may be incomplete, out of date or wrong.
Starverb is for discovery and entertainment — please don't rely on it as an authoritative or factual reference.
§9Availability and changes
We aim to keep the Service running but don't guarantee it will be uninterrupted, error-free or always available.
Starverb is under active development and may change, and we may modify, suspend or discontinue all or part of it at any time, with or without notice.
§10Disclaimers
To the fullest extent permitted by law, and subject to Section 11, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement.
§11Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.
If a consumer guarantee applies and cannot be excluded, our liability for failing to meet it is limited (where the law allows) to re-supplying the Service or paying the cost of having it re-supplied.
§12Limitation of liability
Subject to Section 11, and to the fullest extent permitted by law:
- we are not liable for any indirect, incidental, special or consequential loss, or any loss of data, profits or goodwill, arising from your use of (or inability to use) the Service; and
- our total liability to you for all claims connected with the Service is limited to AUD $1, given the Service is provided free of charge.
§13Indemnity
To the extent permitted by law, you agree to indemnify us against claims, losses and costs arising from your breach of these Terms, your User Content, or your misuse of the Service.
§14Suspension and termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service.
Sections that by their nature should survive termination (including Sections 5–13 and 15) will continue to apply.
§15Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that place.
If you use the Service from the EU, UK, US or elsewhere, you may also have rights under your local laws that this clause does not remove.
§16Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to notify you (for example, in the app or by email).
Continuing to use the Service after changes take effect means you accept the updated Terms.
